OGOMED is a supplier of medical and aesthetic products that sells exclusively to licensed medical professionals and is based in Montreal, Quebec, Canada.

We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec’s Act respecting the protection of personal information in the private sector (as amended by Law 25), and, where they apply to you, other privacy laws such as the EU and UK General Data Protection Regulation (GDPR) and U.S. state privacy laws.

By using the Website you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Website.

This person oversees our compliance with this Privacy Policy and handles all privacy requests and complaints.

2. Information we collect

2.1 Information you give us

  • Account information: your email address, username and password when you register or sign in to your account.
  • Order and billing information: first and last name, billing and shipping address, country, state or province, postal code, phone number, email address, order details and any notes you add to your order.
  • Professional verification information: the medical license number you provide at checkout and, where we request it, documents or details that confirm you are a licensed medical professional (for example, license type, issuing authority, clinic or practice name).
  • Payment information: the Website does not process card payments online. After you place an order, our sales manager contacts you to arrange payment by bank transfer or credit card. In that process we receive the information needed to confirm and reconcile your payment (for example, payer name, the bank or card issuer, the last digits of the card, and the transaction reference). Card numbers are handled by our payment processor or bank and are not stored on the Website.
  • Communications: messages you send us by email, phone, contact forms or our support channels, including price match requests and the competitor invoices you attach to them.
  • Voice assistant conversations: if you choose to use the AI voice assistant on the Website, we process the audio of your conversation and its transcript in order to answer your questions (see Section 5).
  • Reviews and feedback: if you leave a review on Trustpilot or respond to a feedback request, the content of your review and the name you choose to display.

2.2 Information we collect automatically

  • Device data: IP address, browser type and version, device type, operating system, language, referring page and approximate location derived from your IP address.
  • Cookies and similar technologies: see Section 6.

2.3 Information from third parties

We may receive information about you from public registers of medical licensing authorities when we verify a license, from shipping carriers (delivery status and tracking events), and from our payment processor or bank (payment confirmation).

2.4 Patient information

We do not need, and ask you not to send us, any information about your patients. Please do not include patient names, health records or other patient data in order notes, emails or other communications with us.

3. How we use your information

We use personal information only for the purposes listed below, or for other purposes we tell you about and, where required, obtain your consent for:

  • To verify that you are eligible to buy. Our products are sold only to licensed medical professionals, so we use your license number and related information to confirm your eligibility before we ship an order.
  • To process and deliver orders, including order confirmation, contacting you to arrange payment, invoicing, packing, shipping, customs clearance and delivery tracking.
  • To manage your account, including sign-in, order history and password recovery.
  • To provide customer support, answer your questions, handle returns, refunds, exchanges and price match requests.
  • To send service messages about your orders, account, and changes to our policies.
  • To send marketing messages about promotions, monthly savings and new products, by email or browser push notification, only where you have given consent. You can withdraw consent at any time (see Section 9).
  • To measure the effectiveness of our advertising.
  • To keep the Website and our customers safe, including protecting against spam, bots, fraud and unauthorized access.
  • To comply with the law, including tax, accounting, customs and product traceability obligations, and to establish or defend legal claims.

4. Legal bases for processing (EU/UK visitors)

If the GDPR applies to you, we rely on the following legal bases: performance of a contract (processing orders and managing your account); legal obligation (verifying professional status, tax and accounting records); legitimate interests (security, fraud prevention, improving our services and business communications with professional customers, balanced against your rights); and consent (non-essential cookies and advertising technologies, push notifications and marketing emails where consent is required).

5. How we share your information

We do not sell your personal information. We share it only with the following categories of recipients, and only to the extent needed for the purposes described above:

  • Shipping and logistics providers and customs brokers, to deliver your order and clear it through customs.
  • Payment processors and banks, to complete and reconcile your payment.
  • Website hosting, security and performance providers, including our web hosting provider and Cloudflare (content delivery, security and the Cloudflare Turnstile bot check on our forms).
  • Advertising partners: Meta Platforms (the Meta Pixel), which helps us measure the results of our advertising and show relevant ads to people who have visited the Website.
  • Communication providers: SendPulse, which delivers browser push notifications if you subscribe to them, and our email service provider.
  • AI voice assistant provider: ElevenLabs, which processes the audio and transcripts of conversations you start with the voice assistant on the Website.
  • Review platform: Trustpilot, which may send you an invitation to review your purchase and hosts the reviews you publish.
  • Professional advisers such as accountants, auditors and lawyers, under a duty of confidentiality.
  • Authorities, when we are required to do so by law, a court order or a lawful request, or when needed to protect our rights, our customers or others.

Our service providers may use your information only to provide services to us and are required to protect it.

6. Cookies and similar technologies

We use cookies, pixels, local storage and similar technologies. They fall into the following categories:

  • Strictly necessary: required for the Website to work, for example to keep items in your cart, keep you signed in, remember the currency you selected, complete checkout, and protect the Website against bots (WooCommerce, WordPress, Cloudflare). These cannot be switched off.
  • Advertising: help us measure and personalize advertising (Meta Pixel).
  • Functional: enable optional features such as push notifications (SendPulse), the voice assistant (ElevenLabs) and Trustpilot widgets.

Advertising and functional technologies that can identify, locate or profile you are disabled until you allow them through our cookie settings, where required by applicable law. You can change your choice at any time through the cookie settings on the Website or by contacting us, and you can block or delete cookies in your browser settings. Blocking strictly necessary cookies may prevent the cart and checkout from working.

You can also manage Meta ad preferences in your Facebook or Instagram account settings.

7. International transfers

We are based in Canada and serve licensed medical professionals worldwide. Your information may be stored and processed in Canada, the United States and other countries where we or our service providers operate. These countries may have data protection laws different from those in your country, and authorities there may be able to access the information under their laws.

Before transferring personal information outside Quebec, we assess whether it will receive adequate protection and put written agreements in place with our service providers. For transfers of data of EU/UK residents, we rely on adequacy decisions (Canada has an EU adequacy decision for organizations subject to PIPEDA) or on standard contractual clauses approved by the European Commission or the UK authorities.

8. How long we keep your information

  • Order, invoice and payment records: for at least six years after the end of the tax year to which they relate, as required by Canadian tax law.
  • Account and professional verification information: for as long as your account is active, and then for 2 years after your last order, unless a longer period is required by law.
  • Support communications and price match requests: up to 3 years after the request is closed.
  • Voice assistant recordings and transcripts: up to 30 days, unless needed to resolve a specific request.
  • Advertising data: according to the retention settings of each tool, generally no longer than 14 months.
  • Marketing preferences: until you unsubscribe, plus a record of your opt-out so that we respect it.

When information is no longer needed, we delete or anonymize it securely.

9. Your rights and choices

Depending on where you live, you may have the right to:

  • access the personal information we hold about you and receive a copy of it;
  • correct information that is inaccurate or incomplete (you can update most account details yourself in My Account);
  • request deletion of your information, subject to the records we are legally required to keep;
  • withdraw your consent at any time, without affecting processing that took place before the withdrawal;
  • object to or restrict certain processing, including processing for direct marketing;
  • receive your information in a structured, commonly used and machine-readable format (data portability);
  • ask that we stop disseminating your information or de-index any link attached to your name, where Quebec law allows it;
  • be informed when a decision about you is made exclusively by automated processing, and present your observations (we do not currently make such decisions);
  • opt out of targeted advertising, and of any “sale” or “sharing” of personal information as defined by U.S. state laws (we do not sell personal information).

Marketing: you can unsubscribe from marketing emails using the link in any email or by contacting us. You can turn off push notifications in your browser settings at any time. We will continue to send service messages about your orders and account.

How to make a request: email our Privacy Officer at [email protected] with “Privacy request” in the subject line or write to the address in Section 1. We may ask you to confirm your identity before we act on the request. We respond within 30 days. We will not discriminate against you for exercising your rights.

10. How we protect your information

We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encrypted connections (HTTPS), access controls that limit personal information to staff who need it, bot and attack protection, and contractual obligations for our service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your account password confidential and contact us immediately if you believe your account has been compromised.

If a confidentiality incident involving your personal information presents a risk of serious injury, we will notify you and the competent authorities as required by law.

11. Children

The Website is intended only for licensed medical professionals and is not directed to anyone under 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us and we will delete it.

12. Third-party websites

The Website may contain links to third-party websites and services, such as manufacturers, Trustpilot and social networks. Their privacy practices are governed by their own policies, and we are not responsible for them.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top shows when it was last changed. If we make material changes, we will notify you by email or by a notice on the Website before the changes take effect.

14. Complaints

If you have a concern about how we handle your personal information, please contact our person in charge of the protection of personal information first, and we will do our best to resolve it.
